Welcome to SA Coal (“we,” “our,” “us”).
These Terms of Service (“Terms”) govern your access to and use of our website https://sacoal.com (the “Site”) and any related services (collectively, the “Services”).
By using this Site, you agree to comply with and be bound by these Terms.

1. Purpose of the Platform

SA Coal operates as a coal trading and verification platform connecting verified coal mines, sites, and qualified buyers in South Africa and abroad.
We verify operational mines and sites, showcase verified listings, and promote transparent, traceable trade.

2. Eligibility

To use SA Coal, you must:

  • Be 18 years or older;

  • Operate a legally registered company (for mines or sites); and

  • Have authority to enter into binding commercial agreements.

We reserve the right to verify your identity and company documentation.

3. Verification Process

Only verified mines and sites may advertise on SA Coal. Verification includes:

  • Submission of CIPC registration, director ID, and proof of operation;

  • Physical or remote site inspection by SA Coal; and

  • Confirmation of active production.

Verification can be suspended or revoked if false or misleading information is provided.

4. Membership & Fees

  • Verified mines/sites must maintain an active membership fee.

  • SA Coal also charges a commission of production sales negotiated with sellers.

  • Invoices are issued monthly based on reported or verified output.

  • Payment is due within 14 days of invoice.

  • Late payments may result in listing suspension or termination.

5. Buyers

Buyers agree to:

  • Purchase only from verified sellers listed on SA Coal;

  • Conduct their own due diligence before payment or collection; and

  • Acknowledge that SA Coal is not responsible for the quality, quantity, or performance of coal sold by any seller.

6. Platform Use

You agree not to:

  • Post false, misleading, or fraudulent information;

  • Copy or distribute content from the Site;

  • Interfere with platform security or attempt unauthorized access.

We may suspend or terminate accounts that violate these Terms.

7. Intellectual Property

All text, graphics, logos, and trademarks on this Site are the property of SA Coal or its affiliates.
No part of the Site may be copied or reused without written consent.

8. Limitation of Liability

SA Coal acts only as a facilitator. We do not take ownership of coal or guarantee transactions.
Under no circumstance shall SA Coal, its directors, or affiliates be liable for any indirect, incidental, or consequential loss arising from use of the Site or Services.

9. Indemnification

You agree to indemnify and hold harmless SA Coal, its directors, employees, and affiliates from any claims, damages, or costs arising from:

  • Your breach of these Terms;

  • Any inaccuracy in your listings; or

  • Disputes between you and other users.

10. Termination

We may terminate your account or verification status without notice if you:

  • Breach these Terms;

  • Fail to pay membership or commission fees; or

  • Submit false or incomplete information.

11. Governing Law

These Terms are governed by the laws of the Republic of South Africa.
Disputes will be resolved in competent South African courts.

12. Updates to Terms

SA Coal may modify these Terms at any time.
Updated versions will be posted on this page with a new effective date.
Continued use of the Site means you accept the revised Terms.
